TUT88 SRL: A services-based company primarily engaged in the provision and trading of marketing, consulting, and technology-driven solutions, including digital marketing, SEO and AI-assisted optimization, data analytics, artificial intelligence, automated tools, affiliate and partner growth services, and performance monitoring and optimization solutions.
Client: Any natural or legal person who contracts or intends to contract the Services provided by TUT88.
Services: Any service provided by TUT88 related to the solutions offered by the Company and/or detailed in the relevant Service Agreements.
These T&C govern the general relationship between the Parties in connection with the Services. They may be supplemented by the Service Agreement to be executed between the Parties, its Annexes, and any additional policies or documents published on this website, all of which form an integral part of the agreement between the Parties.

Subject to compliance with these T&C, the applicable Service Agreement, the relevant Annexes, and the payment of the applicable fees, TUT88 shall provide the Client with the contracted Services.

The Services are provided on an "as is" and "as available" basis. Use of the Services is at the Client's sole risk. To the fullest extent permitted by Uruguayan law, TUT88 shall not be liable for any direct, indirect, incidental, consequential, or special damages, including loss of data, loss of profits, or trading losses arising from the use of the Services.
In any case where liability cannot be legally excluded, TUT88's total liability shall be limited to the amounts actually paid by the Client in the twelve (12) months preceding the event giving rise to the claim.
TUT88 may engage in promotional and advertising activities through various channels, including online ads platforms, social media, email marketing, and paid campaigns. Where required by applicable law, TUT88 shall clearly identify paid or sponsored promotions, advertising content, partnerships, and advertising campaigns created on behalf of clients.
TUT88 does not guarantee specific rankings, performance metrics, conversion volumes, revenue, or results of any kind. Any statements regarding potential performance are based on past experience or general industry benchmarks and should not be interpreted as assured results. All Marketing Services are provided on a best-efforts basis.
TUT88 may use artificial intelligence, machine learning tools, and automated technologies in connection with campaign optimization, content creation, data analysis, and performance monitoring. AI tools are used to enhance efficiency and performance; however, TUT88 does not rely exclusively on AI tools for final strategic decisions without human oversight.
In connection with Marketing Services, TUT88 may process limited and non-sensitive data, including audience segments, advertising performance metrics, and aggregated statistical data. All data processing is conducted in accordance with the Privacy Policy and applicable data protection laws.
Where Marketing Services are provided on behalf of a client, TUT88 acts solely as a marketing and technical service provider. The client remains solely responsible for the accuracy, legality, and regulatory compliance of all claims, content, and representations relating to its products or services.
TUT88 endeavors to design and manage campaigns in compliance with applicable laws and the policies of major advertising platforms, including Google Ads policies, Meta advertising standards, and applicable transparency and disclosure requirements.
The Client waives any contractual or non-contractual claims related to the use of the Services and agrees that TUT88 SRL shall not be liable for any losses or damages arising therefrom. The Client shall indemnify and hold harmless TUT88 SRL from any damage, cost, or expense arising from the Client's breach of these T&C.
The Parties act as independent contractors under a commercial services arrangement. This relationship does not constitute an employment, partnership, agency, or joint venture relationship.
All content available on the Website, including text, software, designs, graphics, images, logos, trademarks, and audiovisual materials, is the exclusive property of TUT88 and/or its licensors and is protected by applicable intellectual property laws. Any unauthorized use of such content without prior written authorization from TUT88 is strictly prohibited.
Your use of the Website and the Services is subject to our Privacy Policy, which governs the collection, use, and processing of personal data.

In the event of any inconsistency between these Terms and Conditions and the Service Agreement executed between the Parties, the provisions of the Service Agreement shall prevail.
These T&C shall be governed by the laws of the Oriental Republic of Uruguay. Any dispute shall be submitted to the exclusive jurisdiction of the competent courts of the city of Montevideo, Uruguay.
